CANADIAN NATIONAL RAILWAY COMPANY, GRAND TRUNK CORPORATION, AND GRAND TRUNK WESTERN RAILROAD INCORPORATED -- CONTROL -- ILLINOIS CENTRAL CORPORATION, ILLINOIS CENTRAL RAILROAD
COMPANY, CHICAGO, CENTRAL & PACIFIC RAILROAD COMPANY, AND CEDAR RIVER RAILROAD COMPANY
On September 14, 1998, Canadian Pacific Railway Company (CPR) filed a motion to
compel applicants to respond to CPR's first set of interrogatories and informal discovery request
numbers 1-68.
On September 17, 1998, Rubicon Inc., and Uniroyal Chemical Company, Inc., moved
that a discovery conference be convened to resolve a number of disputes with applicants
regarding record development. On the same date, Norfolk Southern Railway Company joined in
this request.
A conference will be convened in a hearing room of the Federal Energy Regulatory
Commission, 888 First St., NE., Washington, D.C., on September 28, 1998, commencing at
10:00 a.m., to hear oral arguments for the purpose of ruling on the outstanding discovery
disputes. In the meantime, all counsel are hereby urged to attempt to resolve the matters in
dispute prior to the conference in the spirit of avoiding undue delays in these matters.
This decision is effective on the service date.
