DECEMBER 14, 2011 DO SURFACE TRANSPORTATION BOARD DECISION Docket No. NOR 42125 E.I. DUPONT DE NEMOURS AND COMPANY v. NORFOLK SOUTHERN RAILWAY COMPANY Decided:
December 14, 2011 This decision grants a motion for
extension of time for filing the joint submission of operating characteristics. By
decision served August 25, 2011, the Board adopted a revised procedural
schedule, which required that the joint submission of operating characteristics
be submitted by December 15, 2011.
On December 12, 2011, Norfolk Southern Railway Company and E.I. du Pont
de Nemours and Company filed a joint request to extend this date by seven days,
to December 22, 2011. The parties
state that the requested extension would allow sufficient time to confer about
the calculation of operating characteristics for the movements at issue and to
resolve as many disputes about operating characteristic calculations as
possible. The parties further state that
this extension will not affect any other deadlines in this case. The
motion for extension of time will be granted.
The joint submission of operating characteristics will be due by
December 22, 2011. This
decision will not significantly affect either the quality of the human
environment or the conservation of energy resources. It
is ordered: 1. The motion for extension of time is granted. 2. The joint submission of operating
characteristics is due by December 22, 2011. 3.
This decision is effective on its service date. By
