BNSF RAILWAY COMPANY—ABANDONMENT EXEMPTION—IN KING COUNTY, WASHINGTON (Woodinville Subdivision)

On May 14, 2013, King County, Wash. (King County) filed an emergency motion requesting the Board to compel the attendance of Michael Skrivan, on behalf of CalPortland, at a deposition, or, in the alternative, to issue a subpoena compelling his attendance, and that he produce certain records requested by King County. In its motion, King County specifically requested that the Board compel Mr. Skrivan to attend a deposition scheduled for May 14, 2013, at 9:00 a.m. (and to produce the requested records at or before that time), or at a mutually convenient time and place prior to May 20, 2013. In order for the Board to consider the issues raised by this motion on an expedited basis, any replies to King County’s motion must be filed on May 15, 2013.
This action will not significantly affect either the quality of the human environment or the conservation of energy resources.
It is ordered:
1. All replies to King County’s emergency motion are due on May 15, 2013.
2. This decision is effective on the date of service.
