Decided: April 18, 2014
This decision grants a request by the Alliance for Rail Competition (ARC) to modify the procedural schedule previously adopted in this proceeding.
By decision served on December 12, 2013, the Board invited public comment on how to ensure the Board’s rate complaint procedures are accessible to grain shippers and provide effective protection against unreasonable freight rail transportation rates. The procedural schedule in that decision called for comments to be due by March 12, 2014, and replies to be due by May 12, 2014. On February 10, 2014, the Board issued a decision granting a request by National Grain and Feed Association (NGFA) to modify the procedural schedule and extend the submission due dates by 60 days.
On March 31, 2014, ARC petitioned the Board for a further extension of the procedural schedule. ARC asks that the Board extend the due dates for both the comments and replies by 45 days. ARC requests the extension, in part, to utilize newly available data in its presentation to the Board.
ARC’s request for an extension of time will be granted, and the Board will adopt the following modified procedural schedule:

This action will not significantly affect either the quality of the human environment or the conservation of energy resources.
