ACQUISTION OF CONTROL–TWIN

On August 19, 2009, Stagecoach Group PLC, a noncarrier, its noncarrier intermediate subsidiaries (Stagecoach Transport Holdings plc, SCUSI Ltd., Coach USA Administration, Inc.), Coach USA, Inc., International Bus Services, a motor passenger carrier (MC-155937) controlled by Coach USA, City Sights Twin, LLC, a noncarrier, and Mr. Zev Marmurstein (collectively, Applicants) filed an application under 49 U.S.C. 14303 to acquire control of Twin America, LLC (Twin America) when it becomes a carrier. In a notice served and published in the Federal Register on September 18, 2009 (74 FR 47985-86), the Board requested comments.
By decision served January 12, 2010, the Board adopted a procedural schedule to allow interested persons to submit additional comments and evidence in opposition to the application. The decision made comments due by February 1, 2010, and responses to comments due by February 22, 2010. On February 12, 2010, Applicants filed a petition for extension of time to reply to comments. Applicants state that a 16-day extension would allow them to prepare a thorough response given the time they lost due to the snow storm as well as other circumstances. Applicants also state that an extension of time would not prejudice any party to this proceeding.
Applicant’s request for an extension is reasonable in these circumstances. Consequently, an extension will be granted. Accordingly, the deadline for filing responses to comments will be extended to March 10, 2010.
This decision will not significantly affect either the quality of the human environment or the conservation of energy resources.
It is ordered:
1. Applicant’s request for extension of time is granted.
2. Responses to comments must be filed by March 10, 2010.
3. This decision is effective on its service date.
