41723 SERVICE DATE – JULY 6, 2011 DO SURFACE TRANSPORTATION BOARD DECISION Docket No. AB 101 (Sub-No. 18X) DULUTH, MISSABE AND IRON RANGE RAILWAY COMPANY—ABANDONMENT EXEMPTION—IN ST. LOUIS COUNTY, MINN. Decided: July 5, 2011 On May 26, 2011, Duluth, Missabe and Iron Range Railway Company (DMIR), filed a verified notice of exemption under 49 C.F.R. pt. 1152 subpart F-Exempt Abandonments to abandon 1.96 miles of rail line between mileposts 0.00 and 1.96, in Duluth, St. Louis County, Minn. Notice of the exemption was served and published in the Federal Register on June 15, 2011 (76 Fed. Reg. 35,068-69). By letter filed on June 20, 2011, DMIR states that it has reconsidered abandoning the line and requests withdrawal of the notice of exemption. DMIR’s request for withdrawal is reasonable and will be granted. This action will not significantly affect either the quality of the human environment or the conservation of energy resources. It is ordered: 1. DMIR’s request for withdrawal is granted and the proceeding is terminated. 2. This decision is effective on its date of service. By the Board, Joseph H.
