GENESEE & WYOMING INC.—CONTROL—RAILAMERICA, INC., ET AL.

Decided: November 20, 2012
On September 5, 2012, the Board issued Decision No. 2 in this docket, accepting for consideration the application filed by Genesee and Wyoming Inc. (GWI) and RailAmerica, Inc. (RailAmerica), seeking approval for the acquisition of control of RailAmerica, a noncarrier holding company, by GWI, a noncarrier holding company. Also in Decision No. 2 the Board issued a procedural schedule that left certain deadlines to be determined.
The Board now supplements the procedural schedule issued in Decision No. 2 as follows: (1) the evidentiary proceeding is closed effective November 21, 2012; and (2) a final decision will be issued no later than January 4, 2013.[1] Based on the filings submitted, we determine that no public hearing or oral argument is necessary.
This action will not significantly affect either the quality of the human environment or the conservation of energy resources.
It is ordered:
1. The close of the evidentiary proceeding is November 21, 2012.
2. A final decision will be issued no later than January 4, 2013.
3. This decision is effective on the service date.
